In short

Organic Law 1/2004 defines gender violence as violence against women by men who are or have been their spouses, or who are or have been in a similar intimate relationship with them, even without living together. In Alicante it is investigated by the Violence against Women Section of the Court of First Instance (Sección de Violencia sobre la Mujer del Tribunal de Instancia). As a victim, you are entitled to a protection order, to join the proceedings as a private prosecutor (acusación particular), to free legal aid regardless of your means, and to specific financial support and employment rights.

Before you report

You can call us before taking any step. In a first confidential conversation we assess your situation, what evidence you have and the safest moment to report. Some practical advice:

  • If you are assaulted, go to A&E or your health centre and ask for a medical injury report (parte de lesiones).
  • Keep messages, voice notes and emails somewhere safe that your abuser cannot access.
  • Write down dates, places and anyone who witnessed what happened.

What we do for you

  1. We prepare the complaint and the application for a protection order (orden de protección), with the criminal and civil measures you need.
  2. We go with you when you give your statement at the police station and in court.
  3. We join the proceedings as private prosecution (acusación particular) to defend your interests throughout, including at trial and on appeal.
  4. We coordinate the family side: custody, contact, maintenance and the family home.

Your rights as a victim

  • The right to information and to comprehensive social support.
  • The right to free, immediate and specialised legal aid, regardless of your means. You can also choose a lawyer you trust.
  • The right to a protection order and to the safety measures ordered by the judge.
  • Employment rights, such as reduced or rearranged working hours, relocation or suspension of your employment contract.
  • Specific financial aid when you meet the requirements.

To access these rights, victim status can be proven by a judgment, a protection order, a report from the Public Prosecutor (Ministerio Fiscal) or a report from social or specialist services (article 23 of Organic Law 1/2004).

Frequently asked questions

No. You can report on the basis of your own statement, which can be sufficient evidence if it is credible and consistent. Even so, supporting it with other evidence helps a great deal; we guide you in gathering it without putting yourself at risk.

You can still consult us. In addition, for the purposes of financial aid and rights, victim status can be proven with a report from social or specialist services, without the need for a police report.

Gender violence is a public offence (delito público): once it has been reported, the proceedings continue even if the victim wishes to withdraw. Let’s talk before you make any decision.
