In short

Organic Law 10/2022 on the comprehensive guarantee of sexual freedom put consent at the centre: consent only exists when it has been freely expressed through actions that clearly show the person’s wishes (article 178 of the Criminal Code). Penalties were revised by Organic Law 4/2023. Since 3 October 2025, under Organic Law 1/2025, the investigation of these offences when the victim is a woman falls to the Violence against Women Section (Sección de Violencia sobre la Mujer), even if the attacker is not her partner.

What has changed

  • Consent: since Organic Law 10/2022, any sexual act without consent is sexual assault (agresión sexual). The distinction between sexual abuse and sexual assault no longer exists.
  • Penalties: Organic Law 4/2023 reformed the penalties for cases involving violence or intimidation, or where the victim’s will has been overridden.
  • Specialised court: since 3 October 2025, the Violence against Women Section (Sección de Violencia sobre la Mujer) investigates offences against sexual freedom, female genital mutilation, forced marriage, harassment of a sexual nature and human trafficking when the victim is a woman.

If you have just been assaulted

  • Get to a safe place and, if you can, go to a hospital: medical and forensic evidence is collected there.
  • If possible, do not shower or change your clothes before the examination; keep your clothes in a paper bag.
  • You can report later. There is no immediate deadline, although the sooner you act, the easier it is to preserve the evidence.

Frequently asked questions

The limit is the limitation period for the offence, which depends on the penalty and is several years; for victims who were minors, it starts to run when they turn 35. Even so, acting early makes it easier to preserve the evidence.

The law provides measures to avoid visual contact with the attacker, such as giving evidence by video link or behind screens. We request them whenever you need them.
